OVERVIEW

Welcome to NabbitIt™. The terms “we,” “us,” and “our” refer to NabbitIt™. NabbitIt™ operates this website and provides related information, content, features, tools, products, training, personal bookkeeping services, and other services offered through the website (collectively, the “Services”).

Our website and online store are powered by Shopify, which enables us to provide portions of the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. By visiting, interacting with, registering for, purchasing from, or otherwise using our Services, you agree to these Terms of Service and our Privacy Policy.

If you do not agree to these Terms or our Privacy Policy, you should not use the Services.

SECTION 1 - ACCESS AND ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your state or province of residence or that you have the legal authority necessary to use the Services.

You may be asked to provide information such as your name, email address, mobile phone number, billing information, payment information, or other information necessary to provide the Services.

You are responsible for maintaining the security of any account credentials associated with your use of the Services and for activity occurring through your account.

NabbitIt™ may offer physical products, digital products, personal bookkeeping services, training programs, educational materials, events, memberships, and other services.

Descriptions, availability, features, and pricing may change at any time.

We make reasonable efforts to accurately describe the products and services offered through our website. However, photographs, illustrations, colors, layouts, examples, reports, and other representations may vary from the final product or service.

We reserve the right to modify, discontinue, restrict, or limit any product, program, training, or service at any time.

Participation in NabbitIt™ training does not guarantee certification, clients, business success, revenue, income, or acceptance into any particular NabbitIt™ program.

SECTION 3 - PERSONAL BOOKKEEPING SERVICES

NabbitIt™ provides personal bookkeeping and financial organization services designed to help individuals and households better organize and understand their financial records.

Depending on the service selected, personal bookkeeping may include activities such as:

  • organizing and categorizing household transactions;

  • reconciling accounts;

  • organizing recurring expenses;

  • preparing household profit-and-loss-style reports;

  • preparing personal balance-sheet-style reports;

  • summarizing financial activity; and

  • providing bookkeeping-related administrative support.

NabbitIt™ and Nabbits do not provide investment advice, financial planning, tax preparation, legal advice, credit repair, securities advice, or other regulated professional services unless specifically stated in a separate written agreement and performed by an appropriately qualified professional.

Information presented through our reports, website, training, or Services is intended for bookkeeping, organization, and informational purposes only.

Customers remain responsible for their own financial decisions.

SECTION 4 - ORDERS AND PURCHASES

When you place an order, you are making an offer to purchase the applicable product or service.

NabbitIt™ reserves the right to accept or decline an order for any lawful reason.

An order is not considered accepted until payment has been successfully processed and we confirm acceptance.

Please review your order carefully before submitting it.

If we cancel, modify, or are unable to fulfill an order, we may contact you using the email address, billing information, or phone number provided during the transaction.

Purchases are subject to our Refund Policy.

SECTION 5 - PRICES, SUBSCRIPTIONS, AND BILLING

Prices, promotions, discounts, and service offerings are subject to change.

The price charged will generally be the price displayed when your order or subscription is placed.

Recurring services may be billed monthly or according to another billing schedule disclosed when you enroll.

By enrolling in a recurring service, you authorize us or our payment processor to charge the payment method provided according to the disclosed billing schedule until the service is cancelled or terminated.

You agree to provide accurate and current billing and payment information.

Where applicable, taxes, shipping, processing fees, or other charges may be added to the listed price.

SECTION 6 - SHIPPING AND DELIVERY

For physical products, delivery dates are estimates and are not guaranteed.

We are not responsible for delays caused by carriers, customs processing, weather, supply interruptions, or events outside our reasonable control.

Risk of loss may transfer to the purchaser as permitted by applicable law once an order is delivered to the applicable carrier.

SECTION 7 - INTELLECTUAL PROPERTY

The Services and their content, including without limitation NabbitIt™, the Nabbit character and branding, names, logos, graphics, illustrations, photographs, reports, templates, training materials, workflows, text, videos, audio, downloadable materials, designs, and other content, are owned by or licensed to NabbitIt™ and are protected by applicable intellectual property laws.

You may use materials made available to you only for the purposes expressly authorized by NabbitIt™.

Unless we provide written permission, you may not reproduce, sell, distribute, publish, modify, sublicense, repurpose, or commercially exploit our proprietary materials.

NabbitIt™ names, logos, service names, designs, and slogans may be trademarks of NabbitIt™.

Third-party names and trademarks remain the property of their respective owners.

SECTION 8 - TRAINING AND NABBIT PROGRAM MATERIALS

Training materials, client workflows, templates, onboarding documents, reports, scripts, marketing materials, and other resources provided through NabbitIt™ programs are intended for authorized participants.

Access to training does not transfer ownership of NabbitIt™ intellectual property.

Separate agreements may apply to individuals who become Nabbits, mentors, contractors, independent business owners, or participants in other NabbitIt™ programs.

If a separate written agreement conflicts with these website Terms regarding a specific Nabbit relationship, the more specific written agreement will control for that relationship.

SECTION 9 - OPTIONAL THIRD-PARTY TOOLS

We may provide access to tools or services offered by third parties, including accounting, payment, communications, marketing, scheduling, or technology providers.

Third-party tools may be subject to their own terms and privacy policies.

We do not control every aspect of third-party platforms and are not responsible for their availability, security, operation, or independent acts or omissions.

Your use of third-party tools is at your own discretion and subject to the applicable provider’s terms.

SECTION 10 - THIRD-PARTY LINKS

Our Services may contain links to websites or resources operated by third parties.

We are not responsible for the accuracy, content, policies, security, availability, products, or services of third-party websites.

Please review the applicable third party’s policies before providing information or completing a transaction.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

NabbitIt™ uses Shopify technology to provide portions of the website and online purchasing experience.

Purchases from NabbitIt™ are transactions between you and NabbitIt™, not between you and Shopify.

To the extent permitted by law, Shopify is not responsible for products or services purchased directly from NabbitIt™.

SECTION 12 - PRIVACY

Personal information collected through the Services is handled according to our Privacy Policy.

Our service providers, including Shopify and other technology providers, may process information as necessary to provide their services to us.

By using the Services, you acknowledge that information may be processed by third-party service providers according to their applicable policies and contractual obligations.

SECTION 13 - EMAIL AND TEXT MESSAGING

If you provide your email address and consent to receive marketing communications, NabbitIt™ may send you promotional emails, training information, updates, reminders, and other communications.

You may unsubscribe from marketing emails at any time by using the unsubscribe link included in the message.

If you provide your mobile phone number and separately consent to receive text messages from NabbitIt™, you agree that NabbitIt™ may send informational and/or marketing text messages to the number you provide, including messages sent using automated technology where permitted by law.

Message frequency may vary.

Message and data rates may apply.

Consent to receive marketing text messages is not a condition of purchasing any product or service.

You may opt out of text messages at any time by replying STOP.

For assistance, reply HELP.

Not all mobile carriers or devices are supported, and delivery of text messages is not guaranteed.

Your participation in our SMS program is also subject to our Privacy Policy and any additional disclosures presented when you provide SMS consent.

SECTION 14 - FEEDBACK

If you voluntarily submit ideas, suggestions, reviews, testimonials, comments, or other feedback to NabbitIt™, you represent that you have the right to provide that content.

Unless otherwise agreed in writing, you grant NabbitIt™ a non-exclusive, worldwide, royalty-free right to use submitted feedback for purposes including operating, improving, and promoting our Services.

We are not obligated to compensate you for unsolicited feedback.

You may not submit content that violates another person’s rights or applicable law.

SECTION 15 - ERRORS AND INACCURACIES

Information appearing through the Services may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical errors.

We reserve the right to correct information, modify content, update pricing, or cancel an affected order where permitted by law.

  • misuse NabbitIt™ training, systems, proprietary materials, or customer information.

We may suspend or terminate access if we reasonably believe these Terms have been violated.

Automated systems, bots, agents, or similar technology may not access or interact with portions of the Services in violation of our technical restrictions, instructions, security controls, or applicable law.

We may restrict automated access where necessary to protect the Services, users, intellectual property, or security.

SECTION 18 - TERMINATION

We may suspend or terminate access to the Services where permitted by law, including for violation of these Terms, nonpayment, misuse of our systems, misuse of confidential information, or conduct that threatens the security or integrity of the Services.

Amounts properly due before termination remain payable.

Provisions that by their nature should continue after termination will survive.

SECTION 19 - DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services and products are provided on an “as is” and “as available” basis except where we expressly provide otherwise.

We do not guarantee that use of the Services will produce a particular financial result, business result, number of clients, income level, savings amount, or other outcome.

Examples of income, revenue, earnings, client counts, or business growth shown on the website or in training materials are illustrative and are not guarantees of actual results.

Individual results depend on numerous factors, including effort, experience, market conditions, client acquisition, client retention, expenses, availability, and other circumstances.

Nothing in the Services should be interpreted as a guarantee of business or financial success.

SECTION 20 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, NABBITIT™, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES.

CERTAIN JURISDICTIONS DO NOT ALLOW SOME LIMITATIONS OF LIABILITY, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.

SECTION 21 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless NabbitIt™ and its owners, officers, employees, contractors, service providers, agents, and affiliates from third-party claims arising from your material violation of these Terms, violation of applicable law, or infringement of another party’s rights.

SECTION 22 - SEVERABILITY

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

SECTION 23 - WAIVER AND ENTIRE AGREEMENT

Failure to enforce any provision of these Terms does not waive our right to enforce it later.

These Terms, together with policies and agreements incorporated by reference, constitute the agreement governing your use of the website and Services unless a separate written agreement applies to a particular service or relationship.

SECTION 24 - ASSIGNMENT

You may not assign your rights or obligations under these Terms without our written consent.

NabbitIt™ may assign these Terms as part of a merger, sale, restructuring, transfer of assets, or other lawful business transaction.

SECTION 25 - GOVERNING LAW

These Terms are governed by applicable United States federal law and the laws of the State of Texas, without regard to conflict-of-law principles.

To the extent permitted by law, disputes relating to these Terms or the Services will be brought in an appropriate court located in Texas.

We may update these Terms periodically.

The current version will be posted on this page.

If required by law, we will provide additional notice of material changes.

Continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
